Terms of Service

Welcome to Pinly. These Terms of Service (the "Terms") are a legal agreement between you and Pinly ("Pinly", "we", "us") and govern your use of the Pinly mobile app, the pinlymaps.com website, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use Pinly

You must be at least 13 years old to use Pinly. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. By using Pinly you confirm that you meet these requirements and that the information you give us is accurate.

2. Your account

You can sign in with your email address, with Sign in with Apple, or with Google. You are responsible for the activity that happens under your account and for keeping access to your email and sign-in methods secure. Tell us promptly if you believe someone has used your account without permission.

3. Your username

Your account has a username, shown to other people as an @name. Usernames are assigned on a first-come, first-served basis. A username is a label we let you use while you hold an account — you do not own it, buy it, or acquire any other right in it, and you may not sell, rent, transfer, or trade it, or hold one mainly so that someone else cannot have it.

Pinly is new, and we cannot register in advance every username the Service will need. We therefore reserve the right to reclaim, reassign, or release any username at our discretion. In particular, we may reclaim a username that:

  • we need for Pinly's own official, administrative, editorial, or product use, such as @official, @support, @help, @community, @team, and other generic, brand, or role-based names,
  • impersonates, or is likely to be confused with, another person, business, or brand,
  • infringes someone's trademark or other rights,
  • is being held inactive or unused, or
  • breaks these Terms or is unlawful, deceptive, or abusive.

Reclaiming a username does not delete your account. Your account, your maps, and Your Content stay yours: we will give the account a new, temporary username, and you are free to change it to any other available username that represents you. Where it is reasonably practicable, we will tell you before or when we do this, using the email address on your account. We are not able to offer compensation for a reclaimed username.

4. Your content

Pinly lets you create maps, add places, write descriptions, and upload cover images ("Your Content"). You keep ownership of Your Content. By posting it, you grant Pinly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content for the purpose of operating and improving the Service, including showing your public maps to other people you choose to share them with.

You are responsible for Your Content, and you agree that it will not:

  • infringe anyone's intellectual property, privacy, or other rights,
  • be unlawful, misleading, hateful, harassing, or sexually explicit,
  • contain malware or attempt to interfere with the Service, or
  • misrepresent a place or its location in a way meant to deceive.

We may remove content that we reasonably believe breaks these Terms or the law, and we may suspend or close accounts that repeatedly do so.

5. Maps we build from public sources

Not every map on Pinly is made by the person browsing it. We also build maps ourselves from publicly available information — for example, the places named in the public titles and descriptions of a YouTube channel's videos. These maps record factual information, such as the name and location of a place, alongside a link back to the video the mention came from.

Where a map is drawn from one channel or creator, we may publish it under a Pinly account that carries that channel's name or @handle, so it is clear where the places came from. Unless we state otherwise, that account is created and operated by Pinly, not by the channel. It does not mean the channel is affiliated with Pinly, or that it sponsors, endorses, or has reviewed the map. Names, handles, and marks belong to their respective owners and are used to identify the source.

If you are the creator, channel owner, or rights holder:

  • You can claim the handle. If we are using a username that matches your channel, tell us and we will release it to you once we can confirm you control that channel. This takes priority over anyone else holding it, under section 3.
  • You can ask us to take the map down. If we have built a map from your content and you would rather we did not, tell us and we will remove it, or remove the parts drawn from your content, along with the links and attribution to you. You do not need to give a reason, and you do not need to make a formal copyright complaint.

Either request goes to support@pinlymaps.com, and we will act on it within a reasonable time.

6. Acceptable use

You agree not to misuse the Service. That includes not scraping it at scale, not reverse engineering it except where the law allows, not overwhelming our systems, and not using Pinly to collect information about other people without a lawful basis.

7. Accuracy of map and place information

Pinly displays maps and place information using open data and open-source mapping tools. This information is provided for general reference only. It may be incomplete or out of date, so please use your own judgment before relying on it, especially for travel, safety, or navigation.

8. Pinly's rights

The Service itself, including its software, design, and branding, belongs to Pinly and is protected by intellectual property laws. These Terms do not give you any right to use our name or logo without our written permission.

9. Ending your use

You can stop using Pinly at any time and can delete your account from within the app, which permanently removes your account and the maps you own. We may suspend or end your access if you break these Terms or if we need to for legal or security reasons.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent allowed by law. We do not promise that the Service will always be uninterrupted, secure, or error free.

11. Limitation of liability

To the fullest extent permitted by law, Pinly will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, profits, or goodwill, arising out of your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will take reasonable steps to let you know, for example through the app or by email. Continuing to use the Service after a change means you accept the updated Terms.
